From Paul Curtis White’s appeal: Viewed favorably to the verdict, the evidence established that Eidman was shot and killed at around 11 am on June 8, 2007. Eidman’s wallet was missing from his back pocket, and he had 3 gunshot wounds: a graze wound to the chin; a neck wound caused by a shot fired less than two feet away, which could have been fatal; and a fatal gunshot wound to the head that went through his eye and out the back of his skull. The shot through Eidman’s eye occurred when the victim was on his back with the shooter standing over him and firing at close range. There was no evidence of any other injuries or signs of struggle. All three shots had been fired from the same gun. There were two more unfired bullets on the floor, possibly resulting from the gun having jammed. The wallet and gun were never found.

Surveillance video from a neighboring business showed that a Ford Focus with two people inside had driven past the insurance office twice at 10:50 and 10:54 am on the day of the murder. Several months after the crime, White and Hines were pulled over in a Ford Focus that belonged to Hines. In March of 2010, investigators matched White’s DNA to a swab from inside the victim’s back pocket. The DNA match and the traffic stop led detectives to begin investigating White and Hines for this murder.

White was brought in for questioning multiple times between September of 2010 and June of 2012, and portions of those recorded interviews were played at trial. During the first two interviews, White denied all involvement in the crime and refused to believe the detective when he told White that they had found his DNA on the victim’s clothes. About two weeks later, White was interviewed again. Initially, he again denied any involvement, but ultimately—after discussing the hypothetical possibility that he might be guilty of something less than murder—he admitted that he and Hines committed the robbery together. He explained that he had not wanted to admit to this, but when he heard what Hines and the media had been saying about what happened, he decided to confess.

White told the following story with varying degrees of consistency. White had lost money at the casino early on the morning of the crime. He and Hines, his roommate, needed money and decided to rob people who were cashing checks at Walmart. In one version, White said they abandoned that plan because there were too many cameras at 2 Walmart. Later, he said he saw a man cash a check and sent Hines to get the gun from their house, but by the time he returned, the man had already left. In any case, after aborting the Walmart plan, White suggested they rob his insurance agent instead. He knew there would be cash in Eidman’s office because White and his wife had gone there and made a cash payment to him a little over two months before. White told Hines that Eidman would recognize him. During the first interview, White claimed that he and Hines wore ski masks they had stolen from Walmart. Later, he said they bought bandanas at Walmart and wore those over their faces. There was evidence at trial that Walmart does not stock ski masks in June, but does carry bandanas all year. White tried to explain that by “ski mask” he was only referring generally to having their faces covered. The State argued that the story about masks was a ruse to convince the jury that they only intended to rob Eidman and, therefore, needed to protect their identities.

White said that after leaving Walmart, he and Hines drove to Eidman’s office, drove around the building once, and then entered the office. White saw Eidman sitting at his desk, and they demanded money. In one version, White said Eidman tried to open the drawer where he kept the cash, and then White took the victim’s wallet out of his back pocket. Later, White said that first Eidman claimed there was no money, then White took his wallet and then at some point later White tried opening the desk drawer. White claimed that he started to leave the office after taking his wallet. At some point, Hines fired a shot that gave Eidman a bloody lip. When Eidman denied having any more
money, Hines shot him again and he fell to the floor. White asked Hines if he was dead, and Hines shot Eidman again. White admitted that the gun was his and said that he and Hines split the $300 they got from Eidman’s wallet. He said different things at different
times about how they discarded the evidence.

From the appeal of Larry John Snyder: On July 21, 2009, Phillip Edwards discovered the decomposing body of Davina Chapman under the “four-mile bridge” of U.S. Highway 190 in Pointe Coupee Parish. Edwards was a member of a group of individuals searching for Chapman after she had been reported missing several days earlier. An autopsy later revealed that Chapman suffered numerous lacerations to her liver and spleen. Those injuries caused an accumulation of blood in Chapman’s abdominal cavity and ultimately proved fatal. From Suzanne Schoff’s appeal: Appellant and Husband had one child (“Son”) and lived in Baltimore, Maryland during their marriage.   After separating, Appellant made several attempts to disrupt court-ordered custody arrangements by lodging multiple complaints against Husband with the Baltimore City Department of Social Services (“DSS”).  Appellant alleged Husband was sexually molesting Son during authorized visits.   DSS investigators could not substantiate Appellant’s claims by evidence available or found no evidence existed to support the allegations.   On January 17, 2003, Husband filed a motion for sole legal and physical custody of Son, which the court in Baltimore granted on July 7, 2003.

Appellant and her mother (“Mother”) began plotting the murder of Husband.   Appellant’s desire to have Husband killed was apparently motivated by her anger over their custody battle and her impending loss of control over Son. Appellant and Mother solicited three successive individuals, Robert Atkinson, Victor Tyrell, and James Gilmore, to carry out the murder on Appellant’s behalf.   Appellant and Mother told each of them about the alleged sexual abuse, and that they wanted Husband killed to prevent him from gaining custody of Son. They indicated Appellant was desperate to the point she might hurt herself and/or her children if Husband was not killed.   At various times, Appellant and Mother provided cash, bail money, intimate relationships, room and board, and other favors in exchange for the anticipated assistance.   All three men led Appellant to believe they would assist her, but none of them brought the plan to fruition.

Appellant and Mother then approached Terry Wingler (“Wingler”) to kill Husband.   Wingler and Appellant had a daughter from a brief earlier relationship.   Wingler believed Husband was sexually abusing Son, and that Appellant might hurt herself and/or the children over the custody battle.   Wingler agreed to do the killing, apparently driven by his feelings for Appellant and concern for the children.   Wingler expressed no independent, personal desire to kill Husband.   In fact, they had been childhood friends.

Appellant and Mother coordinated the details of the killing and relayed them to Wingler.   Appellant helped arrange for Wingler to pick up his gun, which Appellant’s uncle had been storing in his home in Virginia.   Appellant drove Wingler from Maryland to Husband’s auto body shop in Pennsylvania to familiarize Wingler with the area.   Mother provided Wingler with a box of bullets for the gun.   Appellant rented a gold-colored car for Wingler so his own vehicle would not be recognized.

On the eve of the killing, Appellant and Wingler stayed in a Baltimore motel with the children.   On August 6, 2002, Wingler left the motel early in the morning with a .32 caliber semiautomatic gun, ski mask, gloves and a sweater, and drove to Pennsylvania in the rental car for the sole purpose of killing Husband.   Around 2:00 p.m., he parked in front of Husband’s auto shop.   Wingler approached Husband, as he worked on a car, and shot him seven times with the .32 caliber semiautomatic gun.   Husband’s girlfriend heard the shots and ran to help him.   Husband died at the scene from fatal gunshot wounds to the torso.   A witness from across the street also heard the shots and observed the shooter, wearing a ski mask, enter the gold-colored vehicle.   After the shooting, Wingler disposed of the weapon, ski mask, gloves, and sweater in a wooded area near the auto shop.   Wingler killed Husband just a few days before Husband was to gain full custody of Son.

Wingler maintained contact with Appellant both before and after killing Husband, when he told Appellant “the job” was done.   Wingler drove back to Baltimore and arranged to meet Appellant so she could return the rental car.   Wingler then drove to a Baltimore hospital to receive care for an injured back.   Appellant, Mother, and the children met Wingler at the hospital and proceeded to a Bob Evans restaurant.   There, officers from the Baltimore City Police Department approached the group and asked to speak with them.   Appellant, Mother, Wingler, and the children accompanied the detectives to the Baltimore City Homicide Unit.

Appellant, Mother and Wingler were subsequently arrested and charged with the murder.3  Wingler ultimately confessed to killing Husband, and entered a plea agreement by which he pled guilty to third-degree murder and criminal conspiracy to commit first-degree murder in exchange for his testimony at Appellant’s trial.   Commonwealth witnesses also included the individuals who heard the shots fired, the individuals Appellant had originally solicited for the killing, the DSS social worker, and the police officer who had investigated the sex abuse allegations.   The Commonwealth also presented detailed testimony from a Sprint witness as to length of the cellular phone calls between Appellant and Wingler on the date of the killing as well as the cell tower locations.   On August 31, 2004, the jury convicted Appellant of first-degree murder and criminal conspiracy to commit first-degree murder.   On October 15, 2004, the court sentenced Appellant to life imprisonment without parole.
